7Feedback Terms of Use

Including the White Label Schedule and the Data Processing Addendum.

These Terms of Use ("Terms") constitute a binding legal agreement between PayForSay s. r. o., a limited liability company incorporated under the laws of the Slovak Republic, with its registered office at Doležalova 3424/15C, 821 04 Bratislava – Ružinov, Slovakia, Business ID (IČO): 54455073, Tax ID (DIČ): 2121683322, VAT ID: SK2121683322 ("Company", "PayForSay", "7Feedback", "we", "us", or "our"), and the person or entity accessing or using the 7Feedback services ("User", "Business", "White Label Partner", "Managed Business", "Customer", or "you").

By creating an account, purchasing or activating a plan, adding a Staff Login, enabling White Label, registering as a Managed Business, submitting feedback through a 7Feedback page, or otherwise accessing the Service, you agree to these Terms. If you act for a business entity, you represent that you are authorised to bind that entity.

1Service

7Feedback is a SaaS platform for collecting customer feedback at the point of experience. It provides one-tap ratings, written comments, optional photo or video attachments, optional customer contact details given with consent, a step towards public review platforms, notification delivery to the business, staff and location attribution, analytics, integrations, APIs, and related feedback-collection tools.

Feedback can be collected through a payment terminal application, a self-service kiosk widget, printed QR codes, receipt printing, fiscal receipt QR codes where supported, chat-bots, direct links, and e-commerce widgets. All entry points open the same feedback page.

7Feedback is also available as the "Customer Feedback" add-on inside 7Stamp. Where you use it in that form, these Terms apply together with the 7Stamp Terms of Use for the underlying account.

2Definitions

Feedback ContentThe rating, the optional written comment, any optional photo or video attachment, and any optional contact detail submitted by a Customer.
Staff LoginThe billing and attribution unit of the Service: a workstation such as a till, a terminal, an API integration or a badge QR code. Feedback is attributed to the location and staff associated with the Staff Login it arrived through.
White Label PartnerA business that enables White Label and provides access to the Service under its own brand, domains, support contacts and legal texts.
Managed BusinessA business onboarded, supported, billed or managed by a White Label Partner under the partner's brand.
Program OperatorThe entity that actually operates the feedback programme and determines its questions, rating scale, follow-up handling and customer relationship. This may be the Business, the White Label Partner or the Managed Business depending on the setup.
Partner Legal TextsThe partner's own Terms of Use, Privacy Policy, Refund/Cancellation Policy, consent wording, cookie disclosures and other customer-facing legal materials.
White Label Service DomainsPartner-branded domains or subdomains used for the admin panel, the customer feedback page, the terminal or kiosk application, or other service interfaces.

3Eligibility and accounts

  • You must be at least 16 years old, or the minimum age required by applicable law, to submit feedback as a Customer.
  • Business accounts must be created by persons authorised to act for the relevant business.
  • You must provide accurate account, billing, tax, support and business information and keep it current.
  • You are responsible for all activity under your account, including actions by staff, contractors, agencies and administrators, and for the security of every Staff Login you create.

4Licence and intellectual property

Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, revocable right to access and use the Service for your permitted business or personal use. We retain all rights in the Service, software, APIs, platform, templates, documentation, databases, designs and technology.

You grant us a limited licence to use logos, images, text, trademarks, brand assets and other content you provide, solely to operate, display, secure, support and improve the Service, including to generate branded feedback pages and related materials.

5Plans, fees and billing

  • The Service is billed per Staff Login, on a monthly or annual basis, at the prices published at the time of purchase or agreed in a written offer.
  • A Staff Login is a workstation, not a person. Adding tills, terminals, API integrations or badge QR codes adds Staff Logins.
  • Direct purchases are processed by the merchant of record or payment provider expressly identified at checkout, on the invoice or on the receipt. Where that entity is not PayForSay s. r. o., the payment contract is with that entity and its terms apply to payment processing.
  • Where a White Label Partner uses its own payment account, checkout, invoice or merchant account to charge a Managed Business, the White Label Partner is the seller and payment merchant for those charges unless the checkout expressly names another merchant of record.
  • Where prepaid access codes or prepaid Staff Logins are offered, they may be locked to a business after activation and may be non-transferable unless the applicable offer expressly says otherwise. Where a code is described as lifetime, it provides ongoing access under the applicable limits; it does not mean unlimited usage.

6Refunds, cancellations, taxes and chargebacks

Refunds and cancellations for direct purchases are governed by our Refund Policy and by the terms of the merchant of record identified at checkout. Refunds and cancellations for partner-billed Managed Business purchases are governed by the White Label Partner's own refund and cancellation terms, unless the checkout or receipt expressly identifies another entity as seller or merchant of record.

White Label Partners are solely responsible for their own pricing disclosures, billing notices, taxes, VAT or sales-tax treatment, refunds, cancellations, chargebacks, auto-renewal notices, consumer notices where applicable, and local-law compliance in partner-managed payment flows.

7Acceptable use

  • Do not use the Service for illegal goods, unlawful services, fraud, deception, spam, malware, phishing, adult sexual services, weapons, tobacco or controlled substances.
  • Do not reverse engineer, decompile, scrape, overload, interfere with or bypass limits of the Service.
  • Do not submit or solicit content that infringes third-party rights, defames an identifiable person, or misleads about a business, its staff or its services.
  • Do not submit feedback you know to be false, or feedback about a business you have not dealt with.
  • Do not use the Service to send marketing communications without a valid legal basis and any required consent.
  • Do not use contact details supplied by a Customer for any purpose other than responding to the specific feedback they were attached to.

8Feedback content

A rating on its own is a complete submission. Comments, photos and videos are optional, and so are contact details.

Feedback Content is submitted for the benefit of the Business identified on the feedback page. We process it on that Business's behalf and deliver it to that Business. We do not publish Feedback Content on any public page of our own, and we do not sell it.

The Business is responsible for how it reads, stores, exports, answers and acts on Feedback Content once delivered, including any decision to contact a Customer who left a contact detail.

Where a Customer provides a contact detail, that detail is given for one purpose only: so the Business can respond to that particular piece of feedback. It is not a marketing opt-in, it does not create a subscriber, and it is deleted on the schedule set out in the Privacy Policy.

9Public review platforms and equal treatment

The feedback page may offer the Customer a step towards a public review platform. That step is subject to rules that are part of the product architecture and cannot be switched off by a Business or a partner:

  • No screen, button or route depends on the rating. A Customer who rated the lowest score and a Customer who rated the highest score are shown the same page, with the same options, in the same order.
  • No filtering or suppression. Every rating is recorded and delivered to the Business, whatever it says.
  • No writing or publishing on the Customer's behalf. The Customer writes their own words and decides whether to publish them.
  • No selective solicitation. A Business must not condition the invitation, the QR code or the terminal prompt on what it expects the Customer to say.
  • No rewards for public reviews. Discounts, bonuses, entries and gifts must not be offered in exchange for a public review.

Public platforms set their own rules and enforce them against the listing of the Business, not against us. Google Maps is the default target and TripAdvisor is available on request. Trustpilot may be used only where the invitation is shown to every Customer without exception. Yelp is not supported, because it prohibits soliciting reviews.

Configuring or operating the Service in a way that breaches this section is a material breach of these Terms, and we may suspend the affected configuration or account.

10Communications and consent

7Feedback sends notification emails to the Business when feedback arrives, plus account, security, billing and service messages. Communications to Customers are limited to what is necessary to handle their submission.

  • Marketing communications require a separate optional consent where required by law. Accepting these Terms or the Privacy Policy is not marketing consent.
  • Refusing or withdrawing marketing consent must never prevent a Customer from submitting feedback or a Business from receiving it.
  • Recipients can manage email preferences through unsubscribe and preference links.
  • Important account, security, legal, billing or service notices may still be sent where necessary to provide the Service, maintain security or comply with legal obligations.

11White Label Schedule

This Schedule applies automatically when a business purchases, enables, activates or uses White Label features, partner-branded domains, partner-branded emails, Partner Legal Texts, or partner-managed Managed Business onboarding.

11.1 Scope

  • White Label may include a partner-branded admin panel, feedback page, terminal and kiosk applications, logos, colours, emails, support contacts, printed materials and Partner Legal Texts.
  • White Label applies to the account or enabled configuration, not automatically to every Staff Login unless the applicable plan or offer says so.
  • Managed Businesses may not see standard 7Feedback prices where the White Label Partner controls their subscription through partner-managed billing.
  • White Label requires a working outbound email configuration before it can be enabled.

11.2 Role allocation by scenario

Managed Business registration on a white-label admin domainThe White Label Partner is normally the controller for Managed Business onboarding data, commercial contacts, pricing, support, partner billing and partner-branded domain interactions. 7Feedback processes that data to operate the platform and also acts as an independent controller for its own security, anti-abuse, platform administration and legal compliance.
Customer submits feedback on a partner-branded pageThe point-of-collection page should identify the Program Operator responsible for that feedback programme. If the Customer is dealing with a Managed Business, the Managed Business should be identified as the controller of the feedback. The White Label Partner may be identified as brand provider, support provider, processor, or independent controller for its own domain analytics and support data, as applicable.
Custom-domain analytics or advertising toolsThe entity deciding the purpose and means of the tracking is the controller for that tracking. Partner-enabled tracking is the partner's responsibility. Security and operational logging controlled by 7Feedback is our responsibility. Joint-controller arrangements should be avoided unless expressly documented.

11.3 Partner Legal Texts and responsibility

The White Label Partner is solely responsible for reviewing, adapting, completing, publishing and maintaining its own Partner Legal Texts, including Terms of Use, Privacy Policy, Refund/Cancellation Policy, consent wording, cookie disclosures, business details, pricing, tax information, refund rules, support details and local-law notices.

Templates, examples, default legal texts, implementation notes and sample clauses provided by us are for convenience only, do not constitute legal advice, and are not a substitute for review by the partner's own qualified legal counsel. We do not guarantee that any template is suitable for the partner's jurisdiction, business model, customer type, industry, tracking configuration, payment flow or legal obligations.

We have no obligation to review, validate, approve, monitor or correct Partner Legal Texts or partner customer communications. The White Label Partner remains responsible even if it used one of our templates or example wording.

11.4 Partner indemnity

The White Label Partner shall indemnify, defend and hold harmless PayForSay s. r. o., its officers, employees, contractors and affiliates from and against any claims, complaints, investigations, fines, penalties, losses, damages, chargebacks, refunds, costs and expenses, including reasonable legal fees, arising out of or related to inaccurate, incomplete, outdated, unlawful, misleading or missing Partner Legal Texts, consent wording, cookie or tracking disclosures, pricing, tax disclosures, refund or cancellation terms, support information, customer communications, partner-enabled tracking tools, partner-managed billing flows, or any breach of section 9 in a partner-operated configuration.

11.5 Custom-domain tracking

By default, White Label Service Domains use only cookies and similar technologies that are strictly necessary to provide the Service, authenticate users, maintain sessions, prevent fraud, secure the platform, remember essential preferences and operate the feedback page and admin workflows, unless optional analytics, advertising or similar tracking is separately enabled through a supported configuration.

The White Label Partner is solely responsible for determining whether partner-enabled optional analytics, advertising, pixels, tags, SDKs or similar tools are lawful in each jurisdiction, obtaining any required consent before such optional tools operate, honouring opt-outs, maintaining accurate cookie and pixel disclosures, and keeping a provider inventory for partner-enabled tools. We may disable or refuse tracking configurations that appear non-compliant or create material legal, security, platform or reputational risk.

12Third-party services

The Service may interoperate with public review platforms, payment terminals and terminal app stores, POS and fiscal receipt systems, messaging platforms, cloud hosting, analytics, email providers, domain providers and partner-enabled integrations. We are not responsible for third-party services outside our control, and their own terms and policies may apply.

13Disclaimer of warranties

THE SERVICE, TEMPLATES, DOCUMENTATION, EXAMPLES, APIs AND WHITE LABEL FEATURES ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS. TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, AND LEGAL SUITABILITY OF TEMPLATES OR PARTNER CONFIGURATIONS. WE DO NOT WARRANT ANY PARTICULAR VOLUME OF FEEDBACK, ANY PARTICULAR RATING, OR ANY PARTICULAR OUTCOME ON ANY PUBLIC REVIEW PLATFORM.

14Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, OUR TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATING TO THE SERVICE SHALL BE LIMITED TO THE AMOUNT ACTUALLY PAID BY YOU TO US FOR THE SERVICE IN THE 12 MONTHS PRECEDING THE EVENT GIVING RISE TO THE CLAIM. FOR FREE USERS, LIABILITY IS LIMITED TO EUR 50. WE ARE NOT LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR EXEMPLARY DAMAGES, LOST PROFITS, LOSS OF DATA, LOSS OF GOODWILL, REPUTATIONAL HARM, OR BUSINESS INTERRUPTION.

15Data Processing Addendum

Where we process personal data on behalf of a Business, White Label Partner or Managed Business as a processor, Appendix A applies and is incorporated into these Terms. If a separate signed data processing agreement exists, that separate agreement controls in case of conflict.

16Governing law and disputes

These Terms are governed by the laws of the Slovak Republic, without regard to conflict-of-law rules. Unless mandatory law requires otherwise, the courts of Bratislava, Slovakia have jurisdiction over disputes arising from these Terms. Consumers may have mandatory rights in their country of residence that cannot be waived by contract.

17Changes

We may update these Terms from time to time. Material changes will be notified through the Service, the website, email or other reasonable means. Continued use of the Service after the effective date of updated Terms constitutes acceptance to the extent permitted by law.

AAppendix A: Data Processing Addendum

This Data Processing Addendum (DPA) applies where PayForSay s. r. o. processes personal data on behalf of a Business, White Label Partner or Managed Business as processor. The controller is the entity that determines the purposes and essential means of the relevant processing.

A1. Subject matter and duration

The subject matter is the provision of the 7Feedback platform, including feedback collection across all entry points, delivery of submissions to the Business, notification emails, staff and location attribution, analytics necessary to operate the service, integrations, support and security. Processing continues for the term of the account, plan, White Label configuration or other agreement, and for any retention period required for security, legal, accounting or dispute purposes.

A2. Nature and purpose of processing

  • Collecting, storing and delivering ratings, comments, attachments and optional contact details.
  • Sending notification and service communications and, where valid consent exists, marketing communications through supported channels.
  • Providing admin, terminal, kiosk, feedback-page, support, security, logging and integration functionality.
  • Maintaining platform integrity, fraud prevention, abuse detection, backups and audit records.

A3. Categories of data subjects and personal data

A4. Processor obligations

  • Process personal data only on documented instructions of the controller, including these Terms, the configuration of the Service, and lawful instructions given through the account or API.
  • Ensure that persons authorised to process personal data are bound by confidentiality obligations.
  • Implement appropriate technical and organisational measures taking into account the state of the art, costs, nature, scope, context and risks of processing.
  • Assist the controller, taking into account the nature of processing, with data-subject requests, security obligations, data protection impact assessments and regulator consultation where required.
  • Notify the controller without undue delay after becoming aware of a personal data breach affecting controller personal data.
  • Delete or return personal data after termination as required by the controller, unless retention is required by law or justified for security, dispute, accounting, backup or legitimate compliance purposes.
  • Make available information reasonably necessary to demonstrate compliance with processor obligations, subject to confidentiality, security and reasonable audit procedures.

A5. Sub-processors

The controller authorises us to use sub-processors necessary to provide the Service, including cloud hosting, authentication, database, email delivery, error logging, analytics necessary for service operation, payment and support providers. We will impose data protection obligations on sub-processors that are materially equivalent to those in this DPA.

A6. International transfers

Where personal data is transferred outside the EEA, the UK or Switzerland, we will use a lawful transfer mechanism, such as an adequacy decision, EU Standard Contractual Clauses, a UK transfer mechanism, Data Privacy Framework certification where applicable, or another lawful safeguard.

A7. California service provider / contractor terms

Where the controller is a business subject to the California Consumer Privacy Act / California Privacy Rights Act and discloses personal information to us for a business purpose, the parties intend us to act as a service provider or contractor, as applicable, for the personal information processed on the controller's behalf. In that capacity we will not sell or share such personal information, retain, use or disclose it outside the direct business relationship except as permitted by applicable law, combine it with personal information from other sources except as permitted by applicable law, or use it for cross-context behavioural advertising. We will assist the controller with applicable consumer requests to the extent required by law and feasible through the Service.

A8. Conflicts

If this DPA conflicts with the main Terms, this DPA controls for processor obligations. If a separately signed DPA or data processing agreement exists, the separately signed agreement controls over this Appendix.
